PROJECT OUTLINE

Redleaf Group was engaged by GHD to conduct a cultural heritage field survey and Native Title assessment for the removal of the existing timber overbridge on Wyatt Road, Kagaru, and its replacement with a modular prefabricated bridge over the Sydney–Brisbane rail corridor. The Construction Impact Zone encompassed road reserve, adjacent pastoral land and rail corridor interfaces, requiring integrated assessment of Aboriginal cultural heritage, local non-Indigenous heritage potential, and tenure/native title constraints. The study combined desktop review of statutory and non-statutory registers, detailed Indigenous and non-Indigenous historical research, field survey with ground-surface visibility analysis, and a structured risk assessment to ensure compliance with the Aboriginal Cultural Heritage Act 2003, Queensland Heritage Act 1992, Environment Protection and Biodiversity Conservation Act 1999 and Native Title Act 1993. Key outcomes included mapping of Category 3–5 Aboriginal cultural heritage risk areas, confirmation of multiple recorded Aboriginal sites within 1 km of the works, recognition of the timber trestle bridge as a potential local heritage asset, and preliminary Native Title findings that rights are likely extinguished within the CIZ due to pre 1996 public works and road dedication.

KEY TASKS

  • Provision of strategic due diligence advice on cultural heritage and Native Title risks associated with the Wyatt Road bridge replacement and associated laydown and access areas.
  • Desktop assessment of Indigenous and non-Indigenous heritage values, including searches of the Aboriginal and Torres Strait Islander Cultural Heritage Database and Register, Queensland Heritage Register, Logan City Council planning scheme overlays and relevant national heritage databases.
  • Cultural heritage field survey focusing on Aboriginal values (including mature trees, elevated ridgelines and areas of limited disturbance), non-Indigenous infrastructure, and overall ground surface visibility constraints within and adjacent to the Construction Impact Zone. 
  • Aboriginal cultural heritage risk categorisation using the Duty of Care Guidelines, including identification and mapping of Category 3 and Category 4 areas within the CIZ and Category 5 mature-vegetation areas immediately adjacent to the works. 
  • Non-Indigenous heritage assessment and risk rating of the Wyatt Road timber trestle bridge, including documentation of its form and fabric and its relationship to the Sydney–Brisbane railway, with recommendations for liaison with Logan City Council and application of finds and monitoring protocols. 
  • Native Title assessment incorporating National Native Title Tribunal searches for the Yuggera Ugarapul People claim, analysis of historical and current tenure (freehold, lease, road parcels and rail corridor) and advice on likely extinguishment of Native Title in the CIZ and residual procedural rights where uncertainty remains. 
  • Preparation of formal cultural heritage and Native Title assessment documentation, including mapped risk areas, ATSICHDR and CHMP context, site management and finds protocols, and recommendations for Traditional Owner consultation and construction-phase mitigation.
